Latest NewsTrading Standards fine non-compliant Agents. Trading Standards have been carrying out spot check on Agents and Property Management companies who are not compliing with new legislation relating to Domestic & Commercial Energy Performance Certificates. A well established firm in Bedforshire were unable to produce EPCS for their commercial property being marketed. Several other Agents have been visited by Trading Standards in Hampshire and Berkshire. Trading standards took action under the "Duty of Care" regulations which state that an Agent is responsible for imforming their clients that an EPC is required when marketing a commercial property for sale or to rent. It was thought to be only the repsonsibility of the owner/landllord of the property to ensure an EPC was carried out, and that sanctions would be against the landlord/owner not the agent. Trading standards have said that this is not the case and that both parties are responsible and could be prosectued for failure to have an EPC available for any property that they are marketing.
